Colombian Freelancers and Spain's Digital Nomad Visa: Is Your RUT Enough Proof of Self-Employment? (2026)

If you are a Colombian freelancer applying for Spain's Digital Nomad Visa (DNV), your RUT (Registro Único Tributario) is usually the starting point for proving you are self-employed. It is the closest Colombian equivalent to a self-employment registration certificate.
On its own, though, it does not always settle the question. The UGE (Unidad de Grandes Empresas), the Spanish office that decides most DNV applications filed from inside Spain, wants to see two things: that you are formally registered, and that you are genuinely working as an independent professional. Depending on your file, a recent RUT may be enough, or it may need to be paired with your tax return, electronic invoices or social security contributions.
This guide explains what your RUT proves, what to add to it, and why changing it at the last minute can hurt your application instead of helping it.
Key Takeaways
- The RUT is a Colombian tax registration with indefinite validity, but the copy you submit should be generated within the three months before you apply.
- The RUT shows that you are registered and which economic activity you declared. It does not, by itself, show income or real activity.
- Common supporting documents are your declaración de renta, DIAN electronic invoices and your certificate of social security contributions as an independent worker.
- Registering late and declaring your real start date is a legitimate correction. Declaring a false earlier date carries a DIAN fine of 100 UVT and can contradict the rest of your file.
- Colombian documents are issued in Spanish, so they do not need a sworn translation for the UGE.
Why the UGE Asks Colombian Freelancers for Self-Employment Registration Proof
The Digital Nomad Visa is regulated by Law 14/2013, as amended by Law 28/2022 (Articles 74 bis to 74 quinquies). Freelancers must show they work remotely for clients outside Spain, with a client relationship of at least three months.
A service contract shows that a client pays you. It does not show that you operate as a recognized independent professional under your own country's rules. That is why the UGE began asking for proof of self-employment registration occasionally around the end of 2025 and the start of 2026. It now checks this consistently in freelance files.
This is a verification practice, not a change in the law. Our guide to self-employment registration proof for the Spain Digital Nomad Visa covers the general rule for every nationality. This article focuses on how it works with Colombian documents.
If the UGE finds the proof missing after you file, it issues a requerimiento. Under Articles 68 and 73 of Law 39/2015, you then have 10 days to respond, or your application can be treated as withdrawn.
What Your RUT Shows (and What It Doesn't)
Under Article 555-2 of Colombia's Estatuto Tributario, the RUT is the single mechanism the DIAN uses to identify, locate and classify taxpayers. For a DNV file, each part of it plays a different role.
| RUT element | What it proves for the DNV | What it does not prove |
|---|---|---|
| NIT and personal data | You are registered with the DIAN | That you are currently working |
| Economic activity (CIIU code) | The type of independent work you declared | That clients actually pay you for it |
| Start date of activity (boxes 47 and 49) | When you declared you began that activity | Income or continuity since that date |
| Tax responsibilities | Your tax obligations, such as income tax | That you have met those obligations |
| Generation date in the footer | How recent your copy is | When you first registered |
One detail catches many applicants. If you first registered in the RUT as an employee, your activity may still show the code for salaried workers (0010). A RUT that only shows salaried employment does not describe independent activity, so it will not support a freelance application until it reflects the work you actually do.
Is the RUT Enough on Its Own for the Spain Digital Nomad Visa?
Sometimes it is. A RUT that shows the right economic activity, a start date well before your client contracts and a recent generation date can clearly prove your registration.
The UGE, however, reviews the file as a whole. If the RUT is recent, if its activity does not match your contracts, or if nothing else in the file shows real independent work, the UGE may ask for more. There is no published list of how many documents are needed. Each file has to be reviewed on its own documentation.
The practical test is consistency. Your RUT, your contracts, your invoices and your bank deposits should describe the same work, for the same clients, over the same period. If you are not sure your documents tell one consistent story, our lawyers can check them in a free case evaluation before you file.
Supporting Documents Colombian Freelancers Use Alongside the RUT
These are the documents Hoply most often uses with Colombian freelancers. They are examples, not a list published by the UGE.
| Document | Issued by | What it adds to your file |
|---|---|---|
| Declaración de renta | DIAN | Declared income and tax activity for the last tax year |
| Electronic invoices | DIAN system | Services billed, client and amount, invoice by invoice |
| Certificate of social security contributions as an independent worker | Your PILA operator or administrators | Ongoing contributions linked to your independent income |
| Client contracts | You and your clients | Remote services and a relationship of at least three months |
| Bank certificate and statements | Your bank | Payments arriving that match your invoices |
| Matrícula mercantil | Cámara de Comercio | Only relevant if you are a merchant (comerciante) |
The social security certificate carries real weight because of how contributions work. Under the rules applied by the UGPP, independent workers contribute on a base of at least 40% of their monthly income, never below one minimum monthly wage (SMMLV). A contribution history that matches your income supports the rest of your file.
The matrícula mercantil is often misunderstood. Under Article 23.5 of the Colombian Commercial Code, services inherent to liberal professions are not commercial acts. A developer, designer or consultant invoicing as a liberal professional usually has no matrícula mercantil, and that is not a gap in the file.

Can You Update Your RUT Retroactively Before Applying?
You may hear that you can "fix" the RUT shortly before applying by changing its dates. It is important to separate what is legitimate from what is risky.
The start date of your activity is a date you declare. If you have been working as a freelancer without registering, you can register now and declare the real date you started. That is a correction, not a strategy. Article 658-3 of the Estatuto Tributario allows the DIAN to sanction registering after the activity has begun, so it is worth discussing with a Colombian accountant.
Declaring a start date that does not reflect reality is a different matter. The same article sets a fine of 100 UVT for providing false, incomplete or incorrect data in the RUT. Late updates are also sanctioned: the RUT must be updated within the month after the change (Article 1.6.1.2.14 of Decreto 1625 de 2016), with fines of 1 UVT per day of delay, or 2 UVT per day when the outdated data is your address or economic activity.
For your visa, a backdated RUT also creates a problem the UGE can see. If the RUT says you started in 2023 but your first invoice, first tax return and first contribution are from 2026, the documents contradict each other. A RUT never replaces evidence of activity, it only frames it. Our guide on how far in advance to register as a freelancer before applying explains why recent registrations need extra support.
Timing, Apostille and Translation for Your Colombian Documents
The DIAN's Circular Externa 000001 de 2023 confirms that the RUT has indefinite validity. Since 2025, the RUT PDF only shows its generation date in the footer of each page, together with a watermark identifying it as a certified copy. Spanish rules, however, expect self-employment proof to be dated within the three months before you apply. In practice, this means downloading a fresh copy from the DIAN portal shortly before filing, after any genuine update is complete.
Colombia is a party to the Hague Apostille Convention, so Colombian public documents are apostilled online through the Cancillería. The channel depends on the document and on how it was signed, so confirm the right option on the Cancillería website for each document you plan to submit, or let your lawyer check it as part of your file.
Translation is simpler. Colombian documents are already in Spanish, so they do not need a sworn translation. That removes one of the slowest and most expensive steps foreign applicants face, as our Spain Digital Nomad Visa guide for Latin Americans explains in detail. For the full list of what goes into the file, see the Spain Digital Nomad Visa document checklist.
Example: A Freelance Designer in Bogotá Preparing Her File
Laura (a fictional name) is a UX designer in Bogotá. She registered in the RUT in 2023 when she left her salaried job, and updated her economic activity to design services at the time. Since then, she has worked for a US agency and a Canadian startup, and she earns more than the €2,849 per month a single applicant needs under the threshold based on Spain's 2026 minimum wage (Real Decreto 126/2026).
Her file pairs a RUT copy downloaded two weeks before filing with her declaración de renta for the last tax year, her electronic invoices for the last three months, her independent-worker contribution certificate, both client contracts and a bank certificate showing each payment.
Every document points to the same activity, the same clients and the same dates. That consistency, more than any single document, is what makes the RUT convincing.
If You Invoice Through a Colombian SAS, a Different Route Applies
Everything above applies to freelancers who invoice as a persona natural. If you work through a company you own, such as a Colombian SAS, you apply through the business owner route instead, which relies on company documents such as the certificado de existencia y representación legal. Our guide for Latin American business owners whose payroll salary is lower than what they actually receive covers that route.
How Hoply Reviews Your RUT and Supporting Documents Before You Apply
A RUT is easy to download and easy to misread. The questions that decide your file are whether its activity matches your contracts, whether its dates fit your invoices and contributions, and whether one document is enough or several are needed.
At Hoply, our immigration lawyers review your Colombian documents before you submit, identify any gap that could trigger a requerimiento, and prepare and file your application with you from start to finish.
